Scope of application

Entry to the "Inktober Perfect Challenge 2024" (hereinafter, "the Promotion") run by Kuretake Co., Ltd. (hereinafter, "we", "us" or "our") shall be in accordance with these Terms and Conditions for Entry (hereinafter, "these Terms"). Please read these Terms carefully and enter the Promotion only if you agree to the content.  By entering the Promotion, you ("the Entrant") are deemed to have agreed to these Terms.

Eligibility to enter the Promotion

If you are under the age of 18, please have your parent or guardian agree to these Terms before entering the Promotion.

About winning entries

If you have entered the Promotion and are selected as a prize winner (hereinafter, "Winner"), we will contact you at the e-mail address you used to enter the Promotion from our official account (sns-campaign★kuretake.co.jp). Please note the following points.

• We will not ask you for the information we need to send prizes, such as your name and address, via DM on social media.  Please check the [About the handling of personal information] section below for details on how we handle the information we receive.

• If you do not provide the necessary information by the deadline after being notified of your winning entry, or if there are any fraudulent items or omissions in the content you have registered or in your contact details, then your winning entry will be invalidated.

• We will not re-send prizes, except in the case of willful misconduct or gross negligence on the part of our company.  In addition, if we cannot deliver your prize because your address (or new address, in the case you have moved) is unknown, or if your prize was not delivered due to errors in the information you provided, then your winning entry will be invalidated.

• Your winning entry may also be invalidated if we otherwise deem it necessary, such as in the case of unauthorized access.

• If winning entries have been invalidated, the number of winners may not reach the maximum number for this Promotion.

• Winners will be notified in mid to late November 2024.

• Prizes will be shipped within 3 weeks after receiving the information necessary for delivery, but this may be delayed depending on various circumstances.

• We cannot accept exchanges, cash exchanges, returns, etc. of winning prizes.

• The resale of winning prizes from the Promotion is prohibited.

About the Provision of Personal Information
If you are required to correctly provide your information, such as your name and address, to enter the Promotion, then you may be excluded from the Promotion if there is any falsehood, error, or omission in any of the information you have provided.

 

About the Handling of Personal Information

• If you are selected as a Winner, we will contact you at the e-mail address you used to enter the Promotion from our official account (sns-campaign★kuretake.co.jp). At this time, we will ask you to provide us with the information necessary to send prizes, such as your name, address, phone number, and email address.

• We will strictly manage the personal information you provide to us, and will use it for Winner notification, prize shipping, and to contact you in relation to prize shipping.

• We will not provide your personal information to third parties without your consent.  Notwithstanding the foregoing, we may provide your personal information in the cases stipulated in our "Privacy Policy", such as when we have been requested to disclose the information based on law, etc.  Please refer to our "Privacy Policy" for more information. For Entrants Located in the EEA and the UK, please review our "GDPR Privacy Policy".

 

Prohibited Acts

The following acts are prohibited when entering the Promotion.  If we determine that you have engaged in any of these prohibited acts, then we may exclude you from the Promotion without prior notice and temporarily unpublish or delete the data you have posted.

• Acts that violate these Terms, the terms of use of the social media account(s) where you post content, and other regulations;

• Make posts that are, or may be, contrary to public order and morals;

• Make posts for commercial purposes or advertising, or posts that constitute solicitation;

• Make posts that hinder the proper operation of this Service or damage trust in the Service;

• Make posts that we determine do not match the theme of the Promotion;

• Make posts that defame individuals, companies, organizations, etc. or violate their privacy;

• Make posts impersonating other person, or posts containing false statements;

• Make posts by fraudulent means;

• Make posts that infringe on the copyright, portrait rights, or other rights of others; or

• Any other acts that we deem to be inappropriate.

 

Suspension of the Promotion, etc.

We may suspend or discontinue the Promotion without prior notice to the Entrant if we deem any of the following grounds to apply.  We assume no responsibility for any disadvantage or damage caused to the Entrant as a result.

• To perform maintenance or inspection, or update, the computer systems related to the Promotion;

• When it becomes difficult to run the Promotion due to force majeure, such as earthquake, lightning, fire, power outage, natural disaster, etc.;

• When computers or communications lines, etc. have gone down as a result of an accident;

• When provision of the social media service used to enter the Promotion is interrupted or discontinued; or

• When we have otherwise deemed it difficult to run the Promotion.

Change to the contents of the Promotion, etc.

We may change the contents of the Promotion in whole or in part without prior notice to the Entrant.  We assume no responsibility for any disadvantage or damage caused to the Entrant as a result.

Disclaimer

• We assume no responsibility for any damage caused to the Entrant in connection with the Promotion, except in the case of willful misconduct or gross negligence on the part of our company.

• We assume no responsibility with respect to trouble arising between the Entrant and other entrants, or between the Entrant and third parties, in connection with the Promotion.

Revision to these Terms

We may revise the contents of these Terms as we deem necessary without prior notice to the Entrant.

Preparation of necessary equipment and cost burden

• The various expenses necessary to enter the Promotion, such as the cost of preparing and installing equipment, software and means of communication, Internet connection fees, communication charges, etc., shall be borne by the Entrant.

• We have no involvement in the preparations, method, etc. of the Entrant's entry to the Promotion.

Other points to note

• We are unable to respond to inquiries regarding the status of entries to the Promotion, the lottery, and winners.

• Winners may be excluded from other promotions run by Kuretake Co., Ltd. in accordance with the provisions of the Act against Unjustifiable Premiums and Misleading Representations.

• The Promotion is a promotion run using social media.  Companies operating the social media services used for the Promotion are not involved in the Promotion.

• For information on how to use social media to enter the Promotion, etc., please refer to the guide for each social media service or contact the relevant operating company.

• Please comply with the terms of each social media service in addition to these Terms.
